Dear Ms. Gillan:

Please consider this a public records request under section 6250 of the Government Code.

As you know, I obtained a copy of William Crist's memo of July 20th in which he transmits a new candidate statement to you, Mr. Burton and Mr. Koester. Since section 554.4, Title 2 of the California Code of Regulations clearly prohibits candidates from changing their statements once submitted, please provide me with information concerning why Mr. Crist's new statement was included with the ballot. Specifically, who made this decision, when was it made, and what was the authority which allowed such a change contrary to CalPERS regulations? Please provide copies of all public records which document this decision.

Also, please provide me with copies of all correspondence from candidates initiating changes to their candidate's statement during the last 5 years after election staff have completed all verifications. For example, this year that would include any substantive changes initiated after Mr. Koester's July 13th letter to candidates requesting their review of the draft ballot booklet. Also include CalPERS correspondence concerning the disposition of any such requests. In addition, please provide me with any evidence that CalPERS has ever changed a candidate's statement at the candidate's request after the candidate has been allowed to review the statements of the other candidates.

As you may know, Mr. Burton (CalPERS CEO) wrote a letter to Pensions&Investments in which he called into question my ethics as a candidate for the CalPERS Board. This was apparently because I signed a letter to that publication as the editor of Corporate Governance (corpgov.net on the internet) rather than identifying myself as a candidate for the Board). His letter appeared in their August 24th edition (my rebuttal appears in the Octover 5th edition). In addition, Ms. Macht (Chief of the Office of Public Affairs) left a message on my answering machine in which she requested I remove vital information from my internet site concerning election issues. In conjunction with these activities, please provide me with copies of all CalPERS correspondence (e-mail, faxes, memos, or letters) issued this calendar year which mention my name or my candidacy.

Urgency: As you may recognize, time is of the essence since the requested information is vital to my campaign for the CalPERS Board. According to a log of returns from last year's election, more than half of all ballots are cast in the first ten days. This is the tenth day in this election cycle. Therefore, please inform me immediately as portions of the above request are available. Please do not wait until all requested information is assembled into one package. Since I work at 400 P Street, I would be glad to drop down and pick up copies as they are made. Please call me at 327-8642.
